LIABILITY WAIVER AND MEDIA RECORDING RELEASE
In consideration of being permitted to participate in a martial arts or yoga activity (hereinafter called “the Program”) taught by Jaya, LLC and its instructors (hereinafter called “the School”), you as an adult student or as the parent/legal guardian of the minor student (hereinafter called “the Participant”) agree to the following:
Understanding of Risks: There are inherent risks and dangers associated with participation in the Program that could result in bodily injury, partial and/or total disability, and even death. These risks and dangers may be caused by the action, inaction, or negligence of the Participant or by the action, inaction, or negligence of others during the Program. There may be other risks not known or not foreseeable at this time.
Acknowledgement of Risks: The Participant assumes full responsibility for any losses and/or damages following such injury, disability, paralysis, or death, however caused. The Participant acknowledges that the activities of the Program are dangerous and could involve the risk of serious injury and/or death, and that injuries received may be compounded by rescue procedures. Furthermore, the Participant understands and agrees that they accept personal responsibility for the damages following any such injury, permanent disability, or death.
Waiver of All Liability: The Participant hereby releases, waives, discharges and covenants not to sue the School (including its instructors, students, managers, and agents, as well as the lessees of the premises and facilities used to conduct the Program) from all liability for any and all claims, demands, losses, or damages on account of any infection or injury, including but not limited to the death of the Participant, arising out of or relating to the Program.
Publicity/Likeness Release: The Participant acknowledges that the Program may be recorded by photo or video and hereby grants the School a perpetual, royalty-free, worldwide license to reproduce the Participant’s likeness and/or voice in promotional media, including but not limited to photos, videos, and mobile applications. The Participant agrees that all waiver of liability herein is extended to circumstances arising from or contributed to by the recording and/or publishing of Program-related promotional media.
The Participant further expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by local, state, and federal laws and that if any portion is held invalid, it is agreed that the balance shall, notwithstanding continue in full legal force and effect. By signing below, the Participant acknowledges that the Participant has read the foregoing, fully understands and agrees to the terms stated here, and intends the below signature to be the unconditional release of all liability to the greatest extent allowed by law.
